K-OREA Location-Based Services Terms

Article 1 (Purpose)

These Terms set out the rights and obligations of SHCODE ("we") and each user of the K-OREA app who agrees to these Terms ("you") when you use the location-based services of K-OREA (the "Service").

Article 2 (Effect and Changes)

  1. These Terms take effect when you tap "Agree" on the consent screen shown the first time you use a location feature in the app.
  2. By tapping "Agree" you confirm that you have read and understood these Terms.
  3. We may amend these Terms within the limits of Korean law, including the Act on the Protection, Use, etc. of Location Information (the "Act").
  4. We will post any amendment, with its effective date, the reason, and the old and new text, in the app and on our website at least 30 days before it takes effect, and notify you in the app of any change that is less favorable to you.
  5. If you do not object by the effective date, you will be deemed to have agreed. If you do not agree, you may withdraw your location consent or stop using the Service.

Article 3 (Governing Rules)

Matters not covered here follow applicable Korean law and general commercial practice.

Article 4 (What We Do With Your Location, and For How Long)

(1) The Service, and how long we keep your personal location information, are as follows.

Korea arrival checkIf you have agreed to location use, your phone uses its GPS to check, on the phone, whether you are in Korea. Only the result (in Korea or not) and the kind of check (GPS, network, or time zone) are sent: (a) to our server, to give you a free arrival day, to start a K Pass that is waiting for your arrival, to apply an invite code, or to start a pass right after purchase, and (b) to our app usage statistics (PostHog) as the "in Korea" and "kind of check" values. The number of "hidden tips nearby" on the map (locked tips within about 2 km of your phone's position, counted on the phone) is also sent to the statistics. Without your agreement we do not use GPS; the check uses your connection's country (IP; our server answers only "Korea" or "other" and keeps nothing) and your phone's time zone.Coordinates are never sent to our server or kept. Our server keeps only the date and the kind of check in your pass record; statistics are kept for up to 12 months.

(2) "Near me" on the map and the starting point of your day plan use your location only on your phone and never send it to our servers. The Korea arrival check also uses your coordinates only on your phone and sends only its result, as shown in the table.

(3) As required by Article 16(2) of the Act, our system automatically records each use of location for the taxi fare estimate (when you start from your current location), nearby pharmacies and hospitals, spot stamps (photo and visit), and the Korea arrival check (when a GPS result, in Korea or not, is sent to our server: a free arrival day, starting a waiting K Pass, an invite code, or starting a pass right after purchase): the time, the feature, how the location was obtained (your phone's operating system), the version of your consent, and a one-way hashed identifier for you. The record never contains coordinates or your IP address. We keep it for 186 days from the day it is made, so never less than 6 months, and then delete it automatically (server disk backups can hold it for up to 7 more days).

(4) Once the purpose is fulfilled we delete your personal location information immediately, except the record in (3), or for up to 1 year if you separately agreed to let us keep it.

(5) To calculate taxi fares and find medical facilities, we pass coordinates, as a lookup only and without anything that identifies you, to NAVER Cloud (Directions API) and to Korea's Public Data Portal (National Medical Center location API).

Article 5 (Fees)

Location features carry no separate charge. Some features require a paid K Pass, sold through Apple or Google in-app purchase.

Article 6 (Adding or Changing Services)

If we add or change a location-based service, we will update Article 4 and post and notify it under Article 2.

Article 7 (Limiting or Suspending the Service)

  1. We may limit or suspend all or part of the Service for maintenance or outages, an outage of an outside map or public-data provider, misuse such as spoofed (mock) location, or force majeure.
  2. We will post the reason and period in the app or on our website, after the fact if unavoidable.

Article 8 (Use and Disclosure of Your Location)

  1. We ask for your consent to these Terms before using your personal location information.
  2. We do not give your personal location information to any third party. If that ever changes, we will tell you who receives it and why, ask for your separate consent, and notify you each time it is given.
  3. You may withhold consent to parts of these Terms; features covered by the withheld part (for example, visit stamps) will not work.

Article 9 (Limits)

Except with your consent, we use your location information and usage records only as described here, except for billing settlement or for statistics, research, or market research in a form that cannot identify any individual.

Article 10 (Your Rights)

  1. You may withdraw all or part of your consent at any time; we will then delete the related location information and usage records without delay.
  2. You may pause the use of your location at any time (Settings in the app), and we will not refuse.
  3. You may ask to see your location usage records, and the reason and details of any disclosure required by law, and ask us to correct errors.
  4. Use My → Settings → Location in the app, or email 4ddesigner@naver.com with the account ID shown in the app.

Article 11 (Children and Legal Guardians)

  1. The Service is not for children under 14. The consent screen asks you to confirm you are 14 or older. If we learn that we processed the location of a child under 14, we will delete it without delay.
  2. If we ever collect, use, or disclose the personal location information of a child under 14, we will first obtain, and verify, the consent of the child's legal guardian under Article 25(1) of the Act. We do not do so at present.
  3. Under Article 25(2) of the Act, a legal guardian may exercise the rights in Article 10 (withdrawing consent, pausing use, and seeing or correcting records) for a child under 14, in the same way as in Article 10(4), once we have confirmed that they are the guardian.
  4. We do not provide services based on the consent of a guardian for children aged 8 or younger and others under Article 26 of the Act.

Article 12 (Location Information Manager)

We appoint a manager responsible for protecting location information and handling complaints; see the Addendum.

Article 13 (Damages)

If we breach Articles 15 to 26 of the Act and you suffer harm, you may claim damages, and we are liable unless we prove we were not at fault.

Article 14 (Governing Law and Courts)

Korean law governs these Terms. Disputes go to the competent court under the Korean Civil Procedure Act, including for users living abroad.

Article 15 (Dispute Mediation)

  1. If a location-related dispute cannot be settled by agreement, we may apply to the Korea Media and Communications Commission (방송미디어통신위원회) for a ruling under Article 28(1) of the Act.
  2. Either you or we may apply for mediation to the Personal Information Dispute Mediation Committee under Article 40 of the Personal Information Protection Act, as provided in Article 28(2) of the Act.

Article 16 (Contact)

The Google Play (Android) version is distributed on our behalf by Unichest Inc.

K-OREA 위치기반서비스 이용약관

제1조(목적)

이 약관은 회원(K-OREA 앱 이용자로서 이 약관에 동의한 개인위치정보주체, 이하 "회원")이 에스에이치코드(SHCODE, 이하 "회사")가 제공하는 K-OREA 위치기반서비스(이하 "서비스")를 이용할 때 회사와 회원의 권리·의무와 그 밖에 필요한 사항을 정합니다.

제2조(약관의 효력 및 변경)

  1. 이 약관은 회원이 앱의 위치 기능을 처음 사용할 때 표시되는 동의 화면에서 동의함으로써 효력이 생깁니다.
  2. 회원이 동의 화면에서 "동의"를 누르면 이 약관을 읽고 이해하여 그 적용에 동의한 것으로 봅니다.
  3. 회사는 「위치정보의 보호 및 이용 등에 관한 법률」(이하 "법"), 「약관의 규제에 관한 법률」 등 관계 법령을 위반하지 않는 범위에서 이 약관을 개정할 수 있습니다.
  4. 약관을 개정할 때에는 적용일자, 개정 사유, 현행 약관과 개정 약관을 명시하여 적용일 30일 전부터 앱과 홈페이지에 게시합니다. 회원에게 불리한 변경은 앱 안 알림으로 개별 통지합니다.
  5. 회원이 적용일까지 거부 의사를 표시하지 않으면 개정 약관에 동의한 것으로 봅니다. 동의하지 않는 회원은 위치 기능 동의를 철회하거나 이용계약을 해지할 수 있습니다.

제3조(관계 법령의 적용)

이 약관에 정하지 않은 사항은 관계 법령과 상관례에 따릅니다.

제4조(서비스의 내용 및 개인위치정보의 보유 목적·기간)

① 회사가 제공하는 서비스와 개인위치정보의 보유 목적·기간은 다음과 같습니다.

한국 도착 확인회원이 위치 이용에 동의한 경우 기기 GPS로 한국 안에 있는지를 기기 안에서 판정합니다. 그 결과(한국 안/밖)와 판정 근거의 종류(GPS·접속망·시간대)만 ① 회사 서버로 보내 도착 하루권 지급, 대기 중인 이용권(K Pass) 시작, 초대 코드 적용, 결제 직후 이용권 시작에 쓰고 ② 앱 사용 통계(PostHog)의 한국 안 여부·판정 근거 값으로 보냅니다. 지도의 "근처 히든 팁" 개수(기기 위치 주변 약 2km 안의 잠긴 팁을 기기가 센 수)도 통계로 보냅니다. 동의가 없으면 GPS를 쓰지 않고 접속 국가(IP, 서버는 "한국/그 외"만 답하고 보관하지 않음)와 휴대폰 시간대로 판정합니다.위치 좌표는 서버로 보내지 않고 보유하지 않습니다. 서버는 이용권 기록에 지급 일시와 판정 근거의 종류만 남기고, 통계 값은 최대 12개월 보관합니다.

② 지도 "내 주변"과 일정의 출발점 계산은 회원 기기 안에서만 위치를 사용하며 회사 서버로 전송하지 않습니다. 한국 도착 확인도 위치 좌표는 기기 안에서만 쓰며, 제1항 표와 같이 판정 결과만 보냅니다.

③ 회사는 법 제16조 제2항에 따라 위치정보 이용·제공사실 확인자료를 자동으로 기록·보존합니다. 기록 대상은 택시 예상 요금(현재 위치를 출발점으로 쓴 경우), 주변 의료기관 찾기, 여행 스팟 도장(사진·방문), 한국 도착 확인(GPS 판정 결과(한국 안/밖)를 서버로 보낸 경우: 도착 하루권, 대기 K Pass 시작, 초대 코드, 결제 직후 시작)이며, 이용 일시·이용한 기능·취득 경로(휴대폰 운영체제)·동의 판·이용자 식별값(일방향 해시)을 기록합니다. 확인자료에는 위치 좌표와 IP 주소를 포함하지 않습니다. 6개월 이상 보존하도록 기록일로부터 186일간 보관한 뒤 자동 파기합니다(서버 디스크 백업에는 최대 7일 더 남을 수 있습니다).

④ 회사는 개인위치정보의 이용 목적을 달성하면 제3항의 확인자료를 제외한 개인위치정보를 즉시 파기합니다. 다만 회원이 보유에 별도로 동의한 경우에는 동의한 때부터 최대 1년간 보유할 수 있습니다.

⑤ 회사는 택시 요금 계산과 의료기관 조회를 위해 좌표를 네이버클라우드(길찾기 API)와 공공데이터포털(국립중앙의료원 위치 조회 API)에 조회 값으로만 전달합니다. 이때 회원을 식별할 수 있는 정보는 함께 보내지 않습니다.

제5조(서비스 이용요금)

위치를 이용하는 기능 자체에는 별도 요금이 없습니다. 일부 기능은 유료 이용권(K Pass)이 필요하며, 요금과 결제는 앱 안 안내와 애플·구글 결제 정책을 따릅니다.

제6조(서비스 내용 추가·변경)

회사가 위치기반서비스를 추가·변경하는 경우 제4조에 반영하여 제2조 제4항·제5항에 따라 게시·통지합니다.

제7조(서비스 이용의 제한 및 중지)

① 회사는 다음 사유가 있으면 서비스의 전부 또는 일부를 제한하거나 중지할 수 있습니다.

  1. 설비 점검·교체·장애
  2. 외부 API(지도·공공데이터) 제공자의 중단
  3. 위치 조작(모의 위치) 등 부정 이용
  4. 국가비상사태 등 불가항력

② 제한·중지 시 사유와 기간을 앱 또는 홈페이지에 게시합니다. 부득이한 경우 사후에 게시할 수 있습니다.

제8조(개인위치정보의 이용 또는 제공)

  1. 회사는 개인위치정보를 이용하여 서비스를 제공하기 전에 이 약관을 명시하고 회원의 동의를 받습니다.
  2. 회사는 회원의 개인위치정보를 제3자에게 제공하지 않습니다. 앞으로 제공하게 되면 제공받는 자와 목적을 미리 알리고 별도 동의를 받으며, 제공할 때마다 제공받는 자, 일시, 목적을 회원에게 즉시 통보합니다.
  3. 회원은 동의할 때 이용 목적과 이 약관 내용 중 일부에 대하여 동의를 유보할 수 있습니다. 이 경우 유보한 기능(예: 방문 도장)은 쓸 수 없습니다.

제9조(개인위치정보의 이용·제공 제한)

회사는 회원의 동의가 있거나 다음 경우를 제외하고는 개인위치정보 또는 확인자료를 이 약관에 명시한 범위를 넘어 이용하거나 제3자에게 제공하지 않습니다.

  1. 서비스 요금 정산을 위하여 확인자료가 필요한 경우
  2. 통계작성, 학술연구 또는 시장조사를 위하여 특정 개인을 알아볼 수 없는 형태로 가공하여 제공하는 경우

제10조(개인위치정보주체의 권리 및 행사 방법)

  1. 회원은 언제든지 개인위치정보 이용 동의의 전부 또는 일부를 철회할 수 있습니다. 이 경우 회사는 해당 개인위치정보와 확인자료를 지체 없이 파기합니다. 일부 철회는 철회한 부분에 한합니다.
  2. 회원은 언제든지 개인위치정보 이용의 일시적인 중지를 요구할 수 있으며, 회사는 이를 거절하지 않고 이를 위한 기술적 수단(앱 설정의 위치 기능 끄기)을 갖춥니다.
  3. 회원은 본인에 대한 확인자료, 그리고 본인의 개인위치정보가 법령에 따라 제3자에게 제공된 이유와 내용의 열람 또는 고지를 요구할 수 있고, 오류가 있으면 정정을 요구할 수 있습니다. 회사는 정당한 사유 없이 거절하지 않습니다.
  4. 회원은 앱 My → 설정의 위치 항목(동의 철회·일시 중지), 또는 이메일 4ddesigner@naver.com 로 위 권리를 행사할 수 있습니다. 열람 요청 시 앱에 표시되는 계정 식별값을 함께 보내 주십시오.

제11조(만 14세 미만 아동과 법정대리인의 권리)

  1. 서비스는 만 14세 미만 아동을 대상으로 하지 않으며, 회사는 위치 기능 동의 화면에서 만 14세 이상임을 확인합니다. 만 14세 미만의 개인위치정보가 처리된 사실을 알게 되면 지체 없이 파기합니다.
  2. 회사가 만 14세 미만 아동의 개인위치정보를 수집·이용 또는 제공하려는 경우에는 법 제25조 제1항에 따라 그 법정대리인의 동의를 받고, 법정대리인이 동의하였는지를 확인합니다. 현재 서비스는 이러한 수집·이용·제공을 하지 않습니다.
  3. 법정대리인은 법 제25조 제2항에 따라 만 14세 미만 아동의 개인위치정보에 대하여 제10조의 권리(동의의 전부 또는 일부 철회, 일시 중지 요구, 확인자료 등의 열람·고지 및 정정 요구)를 행사할 수 있습니다. 행사 방법은 제10조 제4항과 같으며, 회사는 법정대리인임을 확인한 뒤 처리합니다.
  4. 회사는 8세 이하 아동 등의 보호의무자 동의에 의한 서비스(법 제26조)를 제공하지 않습니다.

제12조(위치정보관리책임자의 지정)

회사는 위치정보를 관리·보호하고 회원의 불만을 처리하기 위하여 위치정보관리책임자를 지정하며, 구체적인 사항은 부칙에 따릅니다.

제13조(손해배상)

회사가 법 제15조부터 제26조까지의 규정을 위반하여 회원에게 손해가 생긴 경우 회원은 손해배상을 청구할 수 있습니다. 이 경우 회사는 고의 또는 과실이 없음을 증명하지 못하면 책임을 면할 수 없습니다.

제14조(준거법 및 재판관할)

  1. 이 약관은 대한민국 법령에 따릅니다.
  2. 분쟁에 관한 소는 민사소송법상 관할 법원에 제기합니다. 회원이 외국 거주자인 경우에도 같습니다.

제15조(분쟁의 조정)

  1. 회사는 위치정보와 관련된 분쟁에 대하여 당사자 간 협의가 이루어지지 않거나 협의를 할 수 없는 경우 법 제28조 제1항에 따라 방송미디어통신위원회에 재정을 신청할 수 있습니다.
  2. 회사 또는 회원은 위치정보와 관련된 분쟁에 대하여 당사자 간 협의가 이루어지지 않거나 협의를 할 수 없는 경우 법 제28조 제2항에 따라 「개인정보 보호법」 제40조에 따른 개인정보분쟁조정위원회에 조정을 신청할 수 있습니다.

제16조(회사의 연락처)

Google Play(Android) 판은 주식회사 유니체스트가 배포를 대행합니다.

부칙

  1. (시행일) 이 약관은 2026년 10월 22일부터 시행합니다.
  2. (위치정보관리책임자) 위치정보관리책임자는 다음과 같이 지정합니다. 성명·직위: 조성환 대표 / 연락처: 010-3001-6413, 4ddesigner@naver.com
